If you have been promised a gift or other property from a person that has died but this promise hasn’t been reflected in their Will, we can help.
If you find yourself in a situation where;
- someone promised that you would receive something on their death
- you reasonably expected that to happen and acted in reliance on it
- you have suffered detriment by relying on the promise and
- you later discover that the deceased has reneged to defeat their promise,
you might have a claim in proprietary estoppel.
These are factually and legally complex claims but a successful claim in proprietary estoppel will operate to hold the deceased to their promise. We can guide you through a claim, or the defence of a claim.
