Protecting children’s welfare with expert legal support in public law proceedings
Every Local Authority is required to safeguard and promote the welfare of children within its jurisdiction. Care and Supervision proceedings are initiated by the Local Authority if a child is believed to be at risk of significant harm. If the situation is considered to be urgent, then they will apply for an Emergency Protection Order and a hearing is often listed on the same day or within 24 hours.

They will guide and support you throughout the Court process, which can be very distressing, especially for parents facing the threat of being separated from their children.
During a process which typically takes approximately 26-weeks, we will help to understand and fully engage in any work directed by the Court. We will draft evidence and other documentation on your behalf and arrange specialist legal representation at all hearings up to and including the Final Hearing.
If the local authority has serious concerns for a child, but do not want to apply to Court immediately, they may provide parents with a PLO (Public Law Outline) letter, inviting them to a meeting when welfare concerns will be discussed. Parents are entitled to have legal representation at these meetings and the cost will be met by legal aid.
In care proceedings, the Court appoints a guardian to advocate for the child independently of the Local Authority. The guardian must assess the Local Authority’s actions and will seek legal representation on behalf of the child.

Parents or those with parental responsibility are automatically eligible for legal aid in these proceedings (and the PLO or Pre-Proceedings process), regardless of their financial circumstances. As soon as you engage our assistance, we will make immediate arrangements for a Legal Aid Certificate is be granted. Grandparents must undergo assessment by the Legal Aid Agency before funding can be approved and we will assist with this.
