Agreements for Lease:

An Agreement for Lease is a contract between parties to enter into a Lease at a future date or when certain conditions are met. To avoid disputes later, it’s crucial to finalise the terms of the Lease before entering into the Agreement.

Leases:

A commercial Lease is a binding contract granting tenants exclusive rights to use a property for business. These documents can be lengthy and complex, so obtaining expert legal advice is vital.

Underleases:

This involves a tenant leasing part or all of their space to a subtenant. While the original tenant remains responsible to the landlord, the subtenant must adhere to the underlease terms. We ensure all parties understand their obligations.

Licences to Assign:

If you need to transfer your Lease to another party, for example if you are selling your business, you’ll likely need consent  from your landlord. This consent is given in the form of a Licence to Assign.  We review lease terms and advise on necessary conditions to secure this Licence, ensuring a smooth handover.

Authorised Guarantee Agreements (AGAs):

When a Lease is assigned over to a new tenant, an AGA may be required. It ensures the outgoing tenant guarantees the new tenant’s obligations, such as rent and maintenance. Our expertise simplifies these transitions.

Licence to Change Use

Most commercial Leases specify the uses that a premises can be put.  However, a party might want to put the premises to a different use.  In order to do this planning permission might be required but also, importantly, the consent of the Landlord might be required to permit the premises to be used for new use(s)

Licences to Alter:

Planning significant changes to your leased property beyond simple cosmetic updates, such as repainting or minor repairs? You’ll likely need a Licence to Alter. This protects you from breaching your Lease. We help define the scope of permitted alterations to maintain good relations between landlords and tenants.

Deeds of Variation:

When Lease terms need adjusting—such as removing or imposing new obligations on the parties — Deeds of Variation are used. These documents modify an existing Lease without creating a new one. Our legal team ensures your interests are protected and that all implications are clear.

Deeds of Surrender:

Sometimes, early lease termination is necessary. A Deed of Surrender allows tenants to exit a Lease early, and landlords can regain possession for redevelopment or new tenants. We help negotiate  the terms to protect our client be they landlord or tenant.
